ABDUL SABOOR VS State S. 497(2)---Penal Code (XLV of 1860), S. 489-F---Constitution of Pakistan, Art. 185(3)---Dishonestly issuing a cheque---Bail, grant of---Further inquiry---As per the contents of the crime report, the accused was running a business of poultry; he borrowed some amount from the complainant and to settle the same, he issued the cheque in question to the complainant, which had been dishonored---Accused was behind bars for the last six and half months whereas the maximum punishment provided under the statute for the offence under S. 489-F, P.P.C. was three years and the offence did not fall within the prohibitory clause of S. 497, Cr.P.C.---Case of the accused squarely fell within the ambit of S. 497(2), Cr.P.C. calling for further inquiry into his guilt---Petition for leave to appeal was converted into appeal and allowed, and accused was allowed bail.
