MOHSIN ABBAS VS State Ss. 302 & 34---Qatl-i-amd, common intention---Appreciation of evidence---Benefit of doubt---Call Data Record---Scope---Accused were charged for committing murder of the son of complainant by firing---Prosecution had also relied upon the Call Data Record collected during the investigation of the case so as to prove the guilt of the accused---According to the statement of complainant his son received a call of someone and then left his house---During the investigation of the case or before the Trial Court complainant failed to produce any recording of the call which his son had received on his cell phone from the said unknown caller---No voice record or its transcript had been brought on record---In absence of any voice call data or record, simply the production of the Call Data Record without the disclosure of the detail of the conversation was not relevant to prove any fact supporting the prosecution case against the accused---Circumstances established that the prosecution had failed to prove its case against the accused beyond shadow of doubt---Appeal was allowed and accused was acquitted by setting aside convictions and sentences recorded by the Trial Court.
