MASTER JUMAN BURIRO VS State Ss. 365-a, 109 & 34---anti-Terrorism act (XXVII of 1997), S. 7---Kidnapping or abduction for extorting property, valuable security, etc., abetment, common intention, act of terrorism---appreciation of evidence---Contradictions in the statements of witnesses--- Scope--- accused were charged for kidnapping the brother of complainant for ransom---Record revealed that complainant stated in the FIR that a guard had informed him about the incident but in his 161, Cr.P.C. statement said guard stated that another guard had informed the complainant on telephone---Prosecution case was that during the period when alleged abductee was kept by the accused in their captivity, the accused had made conversation/several calls to the complainant party with regard to payment of ransom amount---However, no CDR/voice record transcript in order to prove such conversation/calls as well as to show the ownership of said mobile phone(s) had been brought on record neither from the area wherefrom the said calls were made nor from the area of their receiving---Circumstances established that prosecution had failed to prove its case against the accused beyond any shadow of reasonable doubt---appeal against conviction was allowed, in circumstances.
