MASTER JUMAN BURIRO VS State Ss. 365-a, 109 & 34---anti-Terrorism act (XXVII of 1997), S. 7---Kidnapping or abduction for extorting property, valuable security, etc., abetment, common intention, act of terrorism---appreciation of evidence---Recovery of ransom amount from the accused---Reliance---Scope---accused were charged for kidnapping the brother of complainant for ransom---Prosecution case was that after arrest of accused, police also made recovery of some of the ransom amount from them---Denomination of such currency notes had not been mentioned in the memo of recovery---No identification memo of recovered currency notes was prepared by Investigating Officer to show that the recovered notes were the same which were allegedly delivered to accused persons as ransom amount by the complainant; in absence thereof, the recovery of currency notes (alleged ransom amount) was of no avail to the prosecution---Circumstances established that prosecution had failed to prove its case against the accused beyond any shadow of reasonable doubt---appeal against conviction was allowed, in circumstances.
