ASIF SHAHZAD VS State Ss. 302, 325, 449 & 460---Qatl-i-amd, attempt to commit suicide, house-trespass in order to commit offence punishable with death, person jointly concerned in lurking house-trespass or house-breaking by night---Appreciation of evidence---Weapon of offence was recovered at the instance of accused---Scope---Accused was charged for committing murder of the daughter of complainant and also trying to commit suicide by firing---Allegedly, 30-bore pistol was recovered at the instance of accused---Said recovery was immaterial because the prosecution had failed to associate any independent witness of the locality and, thus, the mandatory provisions of S.103, Cr.P.C. had flagrantly been violated in that regard---Accused allegedly got recovered the said pistol from the house of one cobbler which was not in exclusive possession of the accused---Circumstances established that the prosecution could not prove its case against the accused beyond any shadow of doubt---Appeal against conviction was allowed, in circumstances.
