AQEEL HUSSAIN VS State Ss. 336 & 336-B---anti-Terrorism act (XXVII of 1997), S. 7---Itlaf-i-salahiyyat-i-udw, hurt caused by corrosive substance, act of terrorism---appreciation of evidence---Motive not proved---Prosecution case was that the accused threw jug full of acid over brother of the complainant, which resulted in injuries on his face, eyes and chest---Motive behind the occurrence was that victim gave some advice to mother of one of the accused persons---No independent evidence was available on the record other than bare assertion that victim of that case tried to advise the mother of co-accused (since acquitted) and due to that grudge occurrence in hand took place---Even otherwise motive was not attributed to the present accused rather same was attributed to the co-accused---Motive itself was not proof of a crime rather a cause of a crime, which needed to be proved through coherent and tangible evidence---Circumstances established that the prosecution had failed to prove its case against the accused beyond any reasonable doubt---appeal was allowed and accused was acquitted by setting aside convictions and sentences recorded by the Trial Court.
