GHULAM ABBAS PIRZADO VS SHABIR AHMED MAHESAR S. 3--- Qanun-e-Shahadat (10 of 1984), Art. 129(g)---Prevention of illegal possession of property---Withholding best evidence---Scope---Complainant assailed the acquittal of accused---SHO (Station House Officer) during investigation had not stated that the accused had illegally and forcibly dispossessed the complainant from the house and had stated that the house usually remained closed and after some time accused started living in the said house---Witnesses whose statements were recorded by the S.H.O. were not produced by the complainant, which suggested that had they been examined, they would have not supported the prosecution case---Complainant had failed to prove his case against the accused beyond a reasonable doubt---Appeal against acquittal was dismissed.
