MUHAMMAD SAMI alias MUHAMMAD ADIL VS State Ss. 302(b) & 34---Qatl-i-amd, common intention---Appreciation of evidence---Sentence, reduction in---Recovery of dead body on the pointation of accused---Reliance---Scope---Accused was charged that he along with his co-accused committed murder of the brother of complainant by strangulation and then his throat was cut by knife---Record showed that the accused was arrested by police under S.54, Cr.P.C based on spy information that he was involved in the murder of the deceased at his cattle pen---Accused only hours after his arrest took the police to the cattle pen which he owned where he pointed out the dead body of the deceased hidden under a pile of dung---Only the accused could have known where the body was hidden---Complainant was then contacted by the police who reached the scene of the crime with complainant who had been searching for the deceased---Complainant recognized the deceased as his brother and noticed the marks and wound on his neck and thereafter registered an FIR against the accused and some others---Said fact also corroborated/supported the confession of the accused---Circumstances established that the prosecution had proved its case against the accused beyond any shadow of doubt, however the case of prosecution was largely turned on circumstantial evidence, thus the death sentence was converted into life imprisonment---Appeal was dismissed with said modification in sentence.
