MUHAMMAD SAMI alias MUHAMMAD ADIL VS State Ss. 302(b) & 34---Qatl-i-amd, common intention---Appreciation of evidence---Sentence, reduction in---Last seen evidence---Scope---Accused was charged that he along with his co-accused committed murder of the brother of complainant by strangulation and then his throat was cut by knife---Complainant being brother of the deceased and a friend of deceased/ witness furnished last seen evidence that they had seen the deceased in the company of accused---No enmity was suggested against either of the said two witnesses who gave their evidence in a straightforward manner and were not dented on cross-examination and their evidence was believable---Deceased went to the cattle pen of accused in order to collect money from accused and in fact the deceased was last seen with accused on the evening when he returned to the cattle pen to collect his money---Circumstances established that the prosecution had proved its case against the accused beyond any shadow of doubt, however the case of prosecution was largely turned on circumstantial evidence, thus the death sentence was converted into life imprisonment---Appeal was dismissed with said modification in sentence.
