NASARULLAH KHAN VS State art. 129(g)--- Criminal Procedure Code (V of 1898), S.103---Withholding material evidence---Non-association of private witnesses at the time of arrest and recovery--- Scope--- Despite of availability of independent / neutral witnesses on spot, non examination of such witnesses drew an inference in view of art. 129(g) of Qanun-e-Shahadat, 1984, that if they had been examined, they would not have supported the case of prosecution---Non compliance of provision of S. 103, Cr.P.C., created doubt in the prosecution story.
