NEMATULLAH KHAN VS ADDITIONAL DISTRICT JUDGE Ss. 5, Sched. & 14---Constitution of Pakistan, Art. 199---Petitioner/husband invoked constitutional jurisdiction of the High Court after more than a year of passing judgment by the Appellate Court---Held, that petition had been filed without explaining the delay caused during the interregnum period(spanning more than a year), therefore, the petition ex-facie was hit by the principle of laches---Even a void order had to be assailed within the period of limitation prescribed under the law---Although no period of limitation was prescribed for invoking the jurisdiction of the High Court, however, the same had to be invoked within reasonable time, which was not done in the present case---Constitutional petition being not maintainable was dismissed, in circumstances.
