AMEER HUSSAIN VS State S. 302(b)---Qatl-i-amd---Appreciation of evidence---Benefit of doubt---Delay of seven hours and thirty minutes in lodging FIR---Scope---Accused was charged for committing murder of the son of complainant by inflicting churri blows---Motive behind the occurrence was an altercation between deceased and accused---Occurrence in the case allegedly took place at 12.30 p.m. whereas the matter was reported to the police on the same day at 8:00 p.m.---Distance between police station and the place of occurrence was ten miles---Delay of about seven hours and thirty minutes in reporting the crime to the police was without any plausible explanation---Witnesses of ocular account did not utter even a single word about the said delay---Said inordinate delay in setting the machinery of law in motion spoke volumes against the veracity of prosecution version---Circumstances established that the prosecution could not prove its case against the accused beyond any shadow of doubt---Appeal against conviction was allowed, in circumstances.
