ABDUL HAFEEZ alias MUMTAZ KALHORO VS State Ss. 302, 387 & 34---anti-Terrorism act (XXVII of 1997), S. 7---Qatl-i-amd, putting person in fear of death or of grievous hurt in order to commit extortion, common intention, act of terrorism---appreciation of evidence---Motive was proved---Scope---accused were charged for committing murder of the nephew of the complainant on refusal for giving Bhatta---Motive was only alleged against the accused as he was demanding the "Bhatta" from the deceased---Even it was established from the evidence of the eye-witnesses that at the time of incident accused asked the deceased that he had not given Bhatta to him and after saying so he directly fired from his pistol on the face of deceased which hit him and he died subsequently as the result of said firearm shot---During cross-examination of all the three eye-witnesses it was even not suggested that accused not demanded Bhatta from the deceased---Prosecution had proved the asserted motive against the accused---Circumstances established that the prosecution had proved its case against the accused beyond any shadow of doubt--- appeal was dismissed accordingly.
