MCB BANK LIMITED VS ADEEL SHAHBAZ STEEL MILLS Ss. 9 & 10---Suit for recovery---Leave to defend---Scope---Wording of S. 10(1) states that in any case in which the summons has been served on the defendant under S. 9(5), the defendant shall not be entitled to defend the suit unless he obtains leave from the Banking Court---While S. 10(3) gives a chance to the defendant to file leave to defend containing substantial questions of law as well as of fact.
