MAQSOOD VS State Ss. 397 & 337-D---Criminal Procedure Code (V of 1898), S. 342---Robbery or dacoity with attempt to cause death or grievous hurt, jaifah---Appreciation of evidence---Defence plea---Investigating Officer influenced against accused---Accused were charged for causing injuries to the brother of complainant when he restricted them from depriving him from his wallet, cash and other documents---In the present case, the plea taken by accused to the effect that Investigating Officer had been influenced by influential persons of a particular community over money transaction, carried weight and that aspect of the defence theory was not kept in juxtaposition by the Trial Court---Circumstances established that the prosecution had failed to prove its case against the accused persons beyond any shadow of reasonable doubt---Appeal against conviction was allowed, in circumstances.
