MAQBOOL AHMED VS State Ss. 324, 365-B, 147, 148, 149 & 511---attempt to commit qatl-i-amd, kidnapping, abducting or inducing woman to compel for marriage etc., rioting, rioting armed with deadly weapon, unlawful assembly, attempt to commit offence---appreciation of evidence---Benefit of doubt---Presence of alleged eye-witness at place of occurrence doubtful---Chance witness---Scope---accused was charged that he and co-accused kidnapped the wife of nephew of complainant and caused firearm injuries to her husband---Complainant was resident of a village at the distance of one mile from village of the injured----Complainant, therefore, was apparently a chance witness and he was not alleged to be an injured person and his presence in the house of injured during odd hours of the night at 02.30 a.m. could not be established by the prosecution---Circumstances established that the prosecution had failed to prove its case against the accused beyond a reasonable doubt---appeal against conviction was allowed, in circumstances.
