SHAMAS-UR-REHMAN VS Mst. NAZEER GUL Ss. 380 & 34---Theft in dwelling house, common intention---appreciation of evidence---appeal against acquittal---Delay of about three days in lodging the FIR---Effect---accused were charged for committing theft of the valuable articles of the complainant lying in a bag---First Information Report was lodged after three days without plausible explanation thereof, which in the wake of previous hostility between the parties being fatal to the prosecution case could not be ignored--- appeal against acquittal was dismissed accordingly.
