SANWAL alias CHARYA VS State Ss. 302 & 34---Qatl-i-amd, common intention---Appreciation of evidence---Safe custody of crime empties---Scope---Accused was charged that he with co-accused in furtherance of their common intention committed murder of the deceased---Pistol allegedly recovered from the accused was found to be matched with the two empties after two years---None had been examined, on point of Safe Custody, by the prosecution---Prosecution had not been able to prove the involvement of the accused beyond shadow of doubt---Appeal against conviction was allowed accordingly.
