SANWAL alias CHARYA VS State Ss. 302 & 34---Criminal Procedure Code (V of 1898), S. 342---Qatl-i-amd, common intention---Appreciation of evidence---Examination of accused---Scope---Accused was charged that he with co-accused in furtherance of their common intention committed murder of the deceased---No question had been put to the accused during course of his examination under S. 342 Cr.P.C., to have his explanation on point of recovery of alleged crime weapon from him and report of Forensic Expert---Accused could hardly be connected with such recovery---Prosecution had not been able to prove the involvement of the accused beyond shadow of doubt---Appeal against conviction was allowed accordingly.
