MASHOOQUE VS State Ss. 302(b) & 34---Qatl-i-amd and common intention---Appreciation of evidence---Sentence, reduction in---Recovery of weapon of offence on the pointation of accused---Reliance---Scope---Accused was charged that he along with co-accused committed murder of the cousin of complainant---Record showed that accused was arrested during investigation---Accused led the police to pointed place and produced the blood stained hatchet which was sent to Chemical Examiner and it was found blood stained---Report of Chemical Examiner was positive and it had been produced in evidence---When taking into consideration the entire evidence of prosecution witnesses, it would clearly go along with prosecution as to manner in which the offence was committed by accused---Circumstances established that the prosecution had proved its case against the accused beyond any shadow of doubt, however, motive was not proved, thus death sentence was reduced to imprisonment for life.
