FAZAL MEHMOOD VS State Ss. 302(b) & 34---Criminal Procedure Code (V of 1898), S. 161---Qatl-i-amd, common intention---Appreciation of evidence---Statement of witnesses were recorded with promptitude---Scope---Accused was charged that he along with co-accused committed murder of the cousin of complainant---All the witnesses gave their S. 161, Cr.P.C. statements to the police with promptitude which left no time for collusion or concoction and there were no improvements in the evidence which they gave in the court as witnesses under oath so as to render their evidence at trial unreliable---Circumstances established that the prosecution had proved its case against the accused beyond any reasonable shadow of doubt---Motive was not proved, thus death penalty was reduced to imprisonment for life---Appeal was dismissed with said modification in sentence.
