BARKAT ALI VS State Ss. 302(b) & 34---Qatl-i-amd, common intention---Appreciation of evidence---Delay of two days in lodging FIR---Effect---Accused were charged that they in furtherance of their common intention committed murder of the son of the complainant---Record revealed that FIR of the incident had been lodged with delay of two days after the incident for which no plausible explanation had been furnished---Such delay could not be overlooked, which obviously reflected consultation and deliberation---Circumstances established that the prosecution had failed to prove its case against the accused beyond any shadow of doubt---Appeal against conviction was allowed, in circumstances.
