Citation Name: 2023 PCrLJ 475 PESHAWAR-HIGH-COURTBookmark this Case SHAFIQ-UR-REHMAN VS State Ss. 397 & 561-a---Penal Code (XLV of 1860), Ss. 302 (b) & 324---Pakistan arms Ordinance (XX of 1965), S. 13---Qatl-i-amd, attempt to commit Qatl-i-amd and possession of illegal firearm---Sentence after sentence awarded in another trial---accused was convicted and sentenced for imprisonment and fine by Trial Court for committing Qatl-i-amd and attempt to commit Qatl-i-amd---Subsequently accused was also tried by another Court for keeping unlicensed firearm and was also convicted and sentenced to imprisonment and fine---accused was aggrieved of not running his two sentences concurrently---Validity---Subsequent sentence to a convict already undergoing a sentence was to commence under first portion of S. 397, Cr.P.C. after expiry of previous sentence simultaneously---Later part of S. 397, Cr.P.C. left it to the discretion of Court whereby the Court could direct for treating sentences to run concurrently---High Court directed to run sentences concurrently awarded in two trial to accused---Petition was allowed accordingly.
