Mir AHMED VS State Ss. 302 & 109---Qatl-i-amd, abetment---Appreciation of evidence---Absconsion of the accused---Accused was charged for committing murder of the brother of the complainant by firing---Accused after the incident chose to remain an absconder---However, father and brothers of accused were arrested and on the charge of conspiracy to commit murder, they faced the trial and subsequently were acquitted---During that period the accused remained fugitive from law and no explanation in that regard had been furnished by him---Though absconsion itself was not sufficient to convict an accused but it was a strong piece of corroborative evidence of the other direct substantive evidence of the case---Circumstances established that the prosecution successfully brought home the charge against the accused beyond any shadow of doubt---Appeal against conviction was dismissed, in circumstances.
