AHMED VS State S. 302(b)--- Qanun-e-Shahadat (10 of 1984), Art. 129(g)---Qatl-i-amd---Appreciation of evidence---Withholding material witness---Effect---Accused was charged for committing murder of the son of complainant by utilizing stone---Record showed that the complainant of the case was not an eye-witness of the incident---Complainant was informed about the incident by a witness but the prosecution had failed to examine that witness---Because of Art. 129 of Qanun-e-Shahadat, 1984 presumption would be that if said witness produced he would have gone against the prosecution---Appeal was dismissed by reducing the sentence from life imprisonment to imprisonment for twenty two years, in circumstances.
