MUNEER AHMED VS State Ss. 324, 336-B & 337-F(i)---anti-Terrorism act (XXVII of 1997), S. 7---attempt to commit qatl-i-amd, hurt by corrosive substance (acid), ghayr-jaifah-damiyah, act of terrorism---appreciation of evidence---Delay in obtaining the acid covered clothes of victim---Scope---accused was charged for throwing acid upon his wife, due to which she sustained acid injuries on her face---Record showed that it was true that the clothes which the complainant was wearing at the time of the acid attack were not immediately handed over to the police shortly after the incident initially reported to the police for medical legal purposes nor to Medico-Legal Officer who examined the complainant and found burnt wounds but that was easily explainable---attack happened a few paces away from the complainant's house and as per her own evidence and that of eye-witnesses she was taken back to her house where quite naturally her clothes were changed by her mother seeing her daughter in such an agonized state before going to the police---Once the FIR was lodged and the accused was arrested the clothes which were worn by the complainant when she was attacked with acid were recovered from her house and sent for chemical examination---Slight delay in obtaining the acid covered clothes was natural and very much explainable based on the particular facts and circumstances of the case---Clothes which the complainant was wearing at the time of the attack as per report of the Chemical Examiner were found to be smothered in acid---Circumstances established that the prosecution had proved its case against the accused beyond a reasonable doubt---appeal was dismissed accordingly.
