RAFAQAT ALI VS AHMAD JAN, SHO, POLICE STATION INQALAB, PESHAWAR S. 22-a---Powers of Ex-officio Justice of Peace---accused arrested, while on bail---Scope---Petitioner sought registration of FIR against SHO (Station House Officer) on the ground that he was arrested while he was on ad-interim pre-arrest bail and that the SHO had taken valuable things including cash amount from his house---Petitioner was on bail, albeit, his father and brother were absconding in the case---Station House Officer along with Lady Constable had raided the petitioner's house and arrested him along with other co-accused, found in possession of Kalashnikov---Co-accused were arrested in the already lodged FIR, besides, another case was registered under S. 15-aa of Khyber Pakhtunkhwa arms act, 2013, wherein, the petitioner was arrested---Petitioner was arrested for having been found in possession of Kalashnikov---Police were performing their statutory duties and application filed under S. 22-a, Cr.P.C. for registration of FIR had no basis but appeared to be counterblast of the case registered under S. 15-aa of Khyber Pakhtunkhwa arms act, 2013---Constitutional petition was dismissed, in circumstances.
