ALLAH YAR VS State S. 497---Punjab Food Authority Act (XVI of 2011), Ss. 22-A, 23, 24, 27, 28 & 32---Offence by large scale manufacturers---Substandard or misbranded food---Unsafe food---Failure to comply with the directions---Unhygienic or unsanitary conditions---Business without license---Bail, refusal of---Scope---Allegation against accused persons was that they were apprehended while preparing synthetic milk in a factory---Contention of accused persons was that they were employees at the factory and that they were not required for further investigation---Held; accused persons could not take the defence that they were simply workers at the factory, because they were busy in preparation of synthetic milk when they were apprehended---Accused persons also could not claim the bail as a matter of right if the offences did not fall within the prohibition contained in S. 497, Cr.P.C. for the reason that still discretion laid with the court and that had to be exercised keeping in view the specific features of each case---Prima facie crime committed by the accused persons was against the society---Accused persons appeared to be enemies of humanity---Such persons did not deserve the discretion of the court as they were also stigma for the country---No case for bail was made out---Application was dismissed, in circumstances.
