ZAHID KHAN VS State Ss. 9(c) & 25---Criminal Procedure Code (V of 1898), S. 103---Possession of narcotic---Appreciation of evidence---Prosecution case was that 46.150 kilograms heroin powder in two katas and 134 heroin capsules from onions were recovered from the premises of accused---Prosecution witnesses were police officials---Effect---Although, no independent mashir was associated for the arrest of accused and recovery of narcotics and it had come in evidence that the police asked independent persons to become mashirs but they refused and the police/ANF in any event had to move quickly to ensure that the accused did not leave the flat with the narcotics---Even otherwise S. 103, Cr.P.C. had been excluded for offences falling under the Control of Narcotic Substances Act, 1997, by virtue of S. 25 of said Act---Appeal against conviction was dismissed, in circumstances.
