Syed ZAHID HASSAN RIZVI VS PROVINCE OF SINDH Up-gradation of post---Scope---Petitioner sought direction to the department for up-gradation of his post from BPS-9 to BPS-16---Validity---Petitioner did not possess minimum length of service to claim up gradation in BPS 16---Up gradation was not a promotion in stricto sensu, therefore, upgradation of post from BPS-9 to BPS-16 would not mean that the incumbent should be promoted in BPS-16 without mandatory length of service---Petitioner was not promoted in BPS-9 rather he was up-graded, therefore, he could not claim up-gradation in BPS-16 as a matter of right---Constitutional petition, being misconceived, was dismissed.
