SHAHID ALI VS FEDERATION OF PAKISTAN through Chancellor Karakorum International University Gilgit Baltistan, Gilgit R.2---Seniority on initial appointment---Scope---Petitioners whoever initially appointed on contract basis challenged the seniority list and sought a direction to the authority for preparation of a fresh seniority list---Validity---Petitioners were initially appointed on contract basis through open advertisement by the selection committee on merit---Where two or more persons were recommended in open advertisement by the selection committee their inter se seniority had to be determined in order of merit assigned by the selection authority---Authorities had prepared the seniority list in accordance with R.2(2) of Civil Servants (Seniority) Rules, 1993 and had not committed any irregularity or illegality while preparing the same---Previous seniority list was prepared and circulated in utter contravention of the relevant provisions, thus, no Fundamental Right of the petitioners was infringed by the authorities---Writ petition, being bereft of merits, was dismissed.
