ALI ASJAD MALHI VS Ms. Syeda NOSHEEN IFTIKHAR S. 9(1)---Power of the Election Commission ('the Commission') to declare a poll void---Scope---Election of the result 'materially affected'---"Materially affected" test---Scope---In deciding whether to issue a declaration to the effect that a re-poll should be held in a constituency (or in certain polling stations), the primary question the Commission has to answer is whether 'grave illegalities or violations have materially affected the result of the election in one or more polling stations or the whole constituency---Under the 'materially affected' test, two distinct methods can be utilized by the Commission to determine the validity of an election; namely, either by tallying the numerical count and/or by assessing the gravity and extent of the violation(s) committed.
