KHURSHEED AHMAD VS PROVINCE OF PUNJAB Public functionary---Scope---Mala fide cannot be attributed to the Executive/Government functionary, performing functions in furtherance of a legal mandate---In absence of any cogent and convincing material in support of plea of mala fide, it shall be presumed that the action taken by the Executive/Government functionary in pursuance to a lawful mandate is not tainted with mala fide.
