MUHAMMAD MUMTAZ SHAH (DECEASED) VS GHULAM HUSSAIN SHAH (DECEASED) O. XLI, R. 27---Production of additional evidence in Appellate Court---Scope---Order XLI, Rule 27, C.P.C. states that generally, no evidence is to be produced at the Appellate stage---But there are two exceptions to the general rule i.e., additional evidence may be produced at the appellate stage if, (i) the court from where the appeal is preferred has refused to admit evidence which it ought to have admitted; or (ii) the Appellate Court requires any document in order for it to pronounce a judgment.
