IMRAN GONDAL VS State S. 302(b)---Qatl-i-amd---Appreciation of evidence---Rule of consistency---Co-accused acquitted on the same set of witnesses---Scope---Accused was charged that he along with his co-accused committed murder of the brother-in-law of the complainant---Record transpired that lady co-accused of the accused who allegedly caused sota blow at the body of deceased had been acquitted of the charge by the Trial Court on the same set of evidence---No appeal against the acquittal of said co-accused had been filed by the complainant or the State---Once prosecution witnesses were disbelieved with respect to a co-accused then they could not be relied upon with regard to the other co-accused unless they were supported by corroboratory evidence coming from independent source and would be unimpeachable in nature but that was not available in the present case---Circumstances established that the prosecution had failed to prove the case against the accused beyond any reasonable doubt---Appeal against conviction was allowed, in circumstances.
