MUHAMMAD ZUBAIR KHAN VS State S. 364-a---Kidnapping or abducting a person under the age of fourteen---appreciation of evidence--- Non-compoundable offence--- Sentence, reduction in--- Scope--- accused was alleged to have been caught red-handed while lifting the grand-daughter of complainant with intention to subject her to sexual lust and thereafter to sell her to some other person---accused managed composition of crime during pendency of appeal---High Court observed that the offence with which the accused was charged was non-compoundable, therefore, no order of acquittal could be passed merely on account of compromise---Findings of Trial Court were based on correct, elaborate and careful examination of the record and did not suffer from any illegality on account of misreading and non-reading of any material piece of evidence---Even the accused had not disputed his conviction but had only prayed for the reduction of sentence on the basis of compromise--- Reconciliation and repentance expressed by the accused was treated as a mitigating circumstance---Conviction of accused was maintained, however, his sentence of 14 years was reduced to 07 years---appeal was dismissed, in circumstances.
