MUHAMMD SAFDAR VS State Ss. 302(b), 364-a, 377, 201 & 34---Qatl-i-amd, kidnapping, sodomy, causing disappearance of evidence of offence, common intention---appreciation of evidence---Benefit of doubt---Recovery of dead body of the deceased on the pointation of accused---Inconsequential---accused were charged that they kidnapped the minor son of the complainant, committed sodomy and murdered him---Prosecution produced a witness to substantiate such aspect of the case---Though said prosecution witness stated that the dead body was recovered in his presence, however, during the course of cross-examination he candidly admitted that statement recorded by the Investigating Officer was not read over to him---Moreover, Investigating Officer while appearing in the witness box stated that said witness and other witness (given up), witnesses of recovery of dead body had not made statements before him that the dead body was discovered on the pointing out of the accused persons---Said fact alone created serious cracks regarding the prosecution story qua recovery of dead body allegedly made on the pointation of the accused persons in presence of witnesses---Circumstances established that the prosecution absolutely failed to bring on record any convincing/reliable evidence/material to establish that the accused were involved in the commission of the alleged offence---appeal against conviction was allowed, in circumstances.
