SGEC-AMC J VS NATIONAL HIGHWAY AUTHORITY Ss. 20 & 34---Stay of proceedings---Effect---When Court stays proceedings in suit instituted by either party to agreement containing arbitration clause, parties are left whether to institute arbitration proceedings with the intervention of Court (as provided under S. 20 of Arbitration Act, 1940), or without intervention of the Court (as provided under Chapter-II of Arbitration Act, 1940)---Where parties to suit, who are also parties to arbitration agreement executed prior to institution of suit, jointly apply for matters in dispute between such parties to be referred to arbitration, Court may treat such application as application under S. 20 of Arbitration Act, 1940 and refers disputes to arbitration.
