Legal WIRE MANUFACTURING INDUSTRY LTD. VS HABIB INSURANCE COMPANY LTD. art. 86(b)---Insurance Ordinance (XXXIX of 2000), S.122---Insurance petition, filing of---Limitation---Petitioner (insured) had itself admitted in relevant para of the insurance petition that the cause of action occurred on 30.04.2017, whereas, the present petition was filed on 19.12.2020 i.e. after more than three and half years of accrual of cause of action---article 86(b) of the Limitation act, 1908, was applicable in the present case which provides limitation of three years from the date of occurrence of cause of action---Petitioner, in the insurance petition, had not given any explanation for the said delay nor any record was presented to meet with the objection raised by the respondent/insurance company---Insurance petition was dismissed being time-barred.
