UMED ALI alias UMEDO NAREJO VS State Ss. 324, 353, 148 & 149---anti-Terrorism act (XXVII of 1997), S.7---attempt to commit qatl-i-amd, assault or criminal force to deter public servant from discharge of his duty, rioting armed with deadly weapon, unlawful assembly, act of terrorism---appreciation of evidence---Benefit of doubt---Delay of four hours and thirty minutes in lodging the FIR---accused were charged for making firing upon police party, due to which one Police Constable sustained firearm injury---Record showed that encounter took place on 02.03.2009 at 05:00 p.m. and it was reported at Police Station at 09:30 p.m. with the delay of 04 hours and 30 minutes for which no plausible explanation had been furnished by the prosecution---Prosecution case was based on spy information and it was a day time incident and the Police Officials had sufficient time to collect independent persons of the locality but SHO avoided the same---according to prosecution evidence, accused was identified by the Police Officials but Police Officials had failed to disclose as to how they knew the accused before the incident---appeal against conviction was allowed, in circumstances.
