Muhammad Ali VS State Ss. 324 & 353--- Sindh arms act (V of 2013), S. 23 (1)(a)--- attempt to qatl-i-amd, police encounter and recovery of firearms--- appreciation of evidence--- Recovery of weapons--- Benefit of doubt--- Charge, proof of--- Onus to prove--- accused was convicted by Trial Court and was variously sentenced with maximum imprisonment upto three years--- Validity--- Recovery of pistol and empties from crime scene were not presented in a clear and sequential manner--- Prosecution was bound to prove its case against accused beyond any shadow of reasonable doubt but no such duty was caste upon accused to prove his innocence--- High Court set aside conviction and sentence awarded by Trial Court as the same was not supported by confidence inspiring evidence and accused was acquitted of the charge--- appeal was allowed, in circumstances.
