Muhammad Jamil Ahmed VS State Ss. 302, 324, 353 & 34---anti-Terrorism act (XXVII of 1997), S. 7---Qatl-i-amd, attempt to commit qatl-i-amd, assault or criminal force to deter public servant from discharge of his duty, common intention, act of terrorism---appreciation of evidence---Recovery of weapon of offence and crime empties---Reliance---Scope---accused were charged for committing murder of the cousin of complainant---Police chased the accused and after exchange of firing, two accused were arrested---after the murder following an encounter with the police, the accused persons were almost arrested on the spot---Unlicensed pistol was recovered from each of them at the time of the arrest---Some of the empties which were recovered from the scene of the murder when compared with the recovered pistols led to positive Forensic Science Laboratory Reports---Fact that there was a delay in sending the pistols and empties for Forensic Science Laboratory would have no impact on the Forensic Science Laboratory Report in the case as no allegation of tampering had been made---Circumstances established that the prosecution had proved its case beyond any shadow of doubt---However, motive was not proved, which factor could be considered as mitigating and justifying the reduction of the death sentence of the accused to that of life imprisonment---appeal was dismissed with said modification in sentence.
