Atta Khan VS State Ss. 302(b), 393 & 34---Qatl-i-amd, robbery, common intention---Appreciation of evidence---Confession, retraction of---Accused were charged for committing murder of the brother of the complainant by strangulation during robbery---With regard to the accused “W” the only evidence against him was the judicial confession of his co-accused "AH" which was not corroborated by any other single piece of evidence---Said accused was not shown on the CCTV at the bank and his finger print was not found at the bank---As such by extending him the benefit of doubt, accused "W" was acquitted of the charge.
