Atta Khan VS State Ss. 302(b), 393 & 34---Qatl-i-amd, robbery, common intention---Appreciation of evidence---Contradictions in the statements of witnesses---Inconsequential---Accused were charged for committing murder of the brother of the complainant by strangulation during robbery---All the witnesses were consistent in their evidence and even if there were some contradictions in their evidence, same were considered as minor in nature and not material and certainly not of such materiality so as to effect the prosecution case and the conviction of the accused persons---Evidence of the witnesses provided a believable corroborated unbroken chain of events from the discovery of the dead body at the bank along with the damaged ATM, along with accused "AH"s presence at the scene to accused "AH"s arrest on suspicion of robbery and murder, to said accused pointing out the co-accused who were arrested on his pointation, to co-accused "AH" confessing to the crime before a Judicial Magistrate, to accused "AH" and "AH"s finger prints being found at the crime scene along with their CDR record linking them to the deceased and the co-accused on the night of the robbery and murder---Appeal of accused persons "AH" and "AH" against conviction was dismissed, in circumstances.
