Ayaz Ali Abro VS State Ss. 302(b) & 34---Qatl-i-amd, common intention---Appreciation of evidence---Sentence, reduction in---Mitigating circumstances---Accused was charged that he along with his co-accused committed murder of the son of complainant---Record showed that prosecutor had conceded that the prosecution had failed to prove motive part of the story and it shall be considered in favour of the accused while determining quantum of the sentence---Where motive, was not proved and the parties were closely related to each other, maintaining death penalty of accused would be harsh and not justified---Consequently, in such circumstances, conviction of the accused under S.302(b) P.P.C was maintained but his sentence of death was altered and converted into imprisonment for life---Appeal was dismissed with said modification in sentence.
