MUQADAR KHAN VS State Ss. 302(b), 324, 337-F(ii) & 34---Qatl-i-amd, attempt to commit qatl-i-amd, ghayr-jaifah damihah, common intention---Appreciation of evidence---Related and interested witnesses---Inconsequential---Accused was charged for firing upon complainant and his nephew with his pistol resulting into injuries on their bodies; injuries sustained by complainant proved fatal because of which he subsequently died---No doubt, both the eye-witnesses were closely related with the deceased besides injured witness was victim of the same occurrence, but they could not be disbelieved on the sole ground of their close relationship with the deceased when otherwise they had given a truthful account of the occurrence in a straight-forward manner---Nor there was any previous enmity between the parties or other ulterior motive to charge the accused in a false case---Circumstances established that the prosecution had proved its case against the accused beyond shadow of doubt--- Appeal against conviction was accordingly dismissed.
