Citation Name: 2024 PCrLJ 42 QUETTA-HIGH-COURT-BALOCHISTANBookmark this Case MUHAMMAD RAHIM VS State S. 302(b)--- Qatl-i-amd---Appreciation of evidence---Benefit of doubt---Motive was proved---Accused was charged for committing murder of the brother of the complainant by firing---Motive of the occurrence as stated by the witnesses was the alleged threat given by the accused to the deceased two weeks prior to the occurrence on the basis of a domestic dispute---Prosecution had failed to produce any corroborative piece of evidence with the statement of eye-witnesses in respect of any domestic dispute between the deceased and the accused---Even both the witnesses did not state a single word in their statement about any relationship of the deceased with the accused---No documentary proof in the shape of FIR in respect of the alleged threat given by the accused to the deceased had been produced by the prosecution---No other independent witness was produced by the prosecution in respect of the alleged threat---Prosecution had failed to prove the motive part of the occurrence---Circumstances established that the prosecution had failed to prove its case against the accused beyond any shadow of doubt---Appeal against conviction was accordingly allowed.
