MUHAMMAD YASIR KHAN VS State Ss. 302(b) & 34---Qatl-i-amd, common intention---Appreciation of evidence---Night time occurrence---Source of light established---Accused were charged that they in furtherance of their common intention committed murder of the deceased who was accompanying the complainant---With regard to the contention regarding the absence of source of light due to the incident taking place in dark hours of the day, the pictures of the place of incident showed the clear presence of a street light, as such the contention was devoid of any merit---Circumstances established that the prosecution had proved its case against the accused persons---Appeal against conviction was dismissed accordingly.
