MUHAMMAD NAWAZ SHAIKH VS PROVINCE OF SINDH through Secretary to Government of Sindh Termination from service---Show-Cause Notice, non-issuance of---Scope and effect---Petitioners (Junior Clerks/ Sanitary Workers posted at Municipal Committee) filed constitutional petition contending that they were terminated without holding regular enquiry and even without serving any Show-Cause Notice---Validity---Record revealed that before termination of services of the petitioners by the respondents / Department, they were not properly served with Show-Cause Notice---Neither any regular departmental enquiry was initiated nor the petitioners were provided any chance of hearing---In view of said aspects, the impugned orders of termination of services of petitioners appeared to be illegal, ultra vires and against the principles of natural justice and fair play---Consequently, High Court set-aside the termination orders of the petitioners, directing the respondents /Department to reinstate the petitioners into service with back benefits, however, the Department would be at liberty to initiate fresh proceedings---Constitutional petition filed by the employees was allowed, in circumstances.
