Secretary, Defence Production Division, Government of Pakistan and others (2003 SCMR 1804), observed that S.13 of the Civil Servants Act, 1973, was in line with the principles laid down by the Shariat Appellate Bench of Supreme Court in case reported as Pakistan and others v. Public at Large and others (PLD 1987 SC 304), thus, validity and proprietary of S. 13 of the Punjab Civil Servants Act, 1974, was not disputed---Undeniably, S. 12 of the Act of 1974 is pari materia to S. 13 of the Civil Servants Act, 1973, therefore it is intra vires the Constitution---Appeal was dismissed, in circumstances.
